Missouri Driving Privilege Restoration After Denial

Understanding Driving Privilege Denial in Missouri

Having your driving privileges suspended or revoked in Missouri can be a significant inconvenience, impacting both personal and professional life. If your license has been revoked due to a 5 or 10 year denial stemming from multiple alcohol related infractions, you will need to petition the Circuit Court and request a restoration of your driving privileges. Requirements include:

  • Serving the denial period and obtain an order of reinstatement from the circuit court in the county where the last alcohol- or drug-related driving conviction occurred. As part of that process, you must register with the Missouri Automated Criminal History Site (MACHS) for a Criminal History Check.
  • File proof of installation of an Ignition Interlock Device (IID) equipped with a camera. The court may also require that the IID be equipped with GPS.
    NOTE: IID must be maintained for a minimum period of six months from the reinstatement date. You will be monitored during the last three months of the six-month period. If you have any violations, as determined by the device manufacturer during the monitoring period, your requirement to maintain the device will be extended until you complete a three-consecutive-month period without violation. Violations are defined in 7 CSR 60-2.010 (refer to "violations reset" language);
  • You may be eligible to apply for a Limited Driving Privilege (LDP) through the circuit court in the county where you live or work.

Eligibility for Restoration

The first step towards restoring your driving privileges in Missouri is determining your eligibility. A check of your most recent driving record will show the date you are eligible to reinstate.

Steps for Driving Privilege Restoration

1. Complete Mandatory Programs In Missouri this usually means completing a Substance Abuse Treatment Offender Program (SATOP). Successfully completing this type of course is often mandatory for reinstatement.

2. Payment of Fees and Fines: Clearing any outstanding fines or fees is crucial. Ensure that all financial penalties associated with your violations are paid in full to avoid delays in the restoration process. You will be required to pay a Reinstatement Fee.

3. Submission of Documentation: Missouri law requires the submission of specific documents to the Department of Revenue. This typically includes proof of program completion and other court-mandated documents.

4. Reapplications for a License: Once all requirements are met, you can reapply for your driver’s license. This step may include retaking the written and driving tests, especially if several years have passed since your last test.
